Q.  If I have employees who fall under the DOT regulations for drug testing who are filling in and they are already in a random pool for the same job type, do we have to do pre-employment drug screens?

A.  No, as long as you follow the regulations under 382.301 (b) Exceptions for pre-employment testing.

Q. Do I have the right to obtain a copy of my federal drug screen results?

A.  Yes. Under regulation 382.405 (b) Access to facilities and records.  A driver is entitled, upon written request, to obtain copies of any records pertaining to the driver's use of alcohol or controlled substances, including any records pertaining to his or her alcohol or controlled substances.
